1. Introduction

Bkomas Auto, operated by Bkomas Rentals and Auto, provides a comprehensive digital platform connecting vehicle owners, drivers, and customers across Ghana. Our services include online car rental, peer-to-peer vehicle sharing, vehicle sales, chauffeured driving, and fleet management solutions, all accessible through our website and management system

By accessing or using Bkomas Auto's services in any capacity, you confirm that you have read, understood, and agreed to be legally bound by these Terms & Conditions ("Terms"). These Terms, together with our Privacy Policy, applicable insurance terms, and platform policies, constitute the full legal agreement ("Agreement") between you and Bkomas Auto.

2. Modifications to These Terms

Bkomas Auto reserves the right to update or revise these Terms at any time. Any changes will be posted on our platform along with a revised "Last Updated" date. Your continued use of our services following any modification constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the platform and close your account.

3. Eligibility, Registration & Verification

3.1 Who May Use Bkomas Auto

Our services are available exclusively to licensed drivers who are at least 21 years of age. The platform is not available to any user who has previously been removed due to a violation of our Terms, unless Bkomas Auto has issued a written notice of reinstatement.

All users must satisfy our eligibility requirements and submit complete, accurate documentation as may be requested during registration or at any point during use of the platform.

3.2 Account Types

Bkomas Auto supports the following account types. Each carries specific rights, responsibilities, and verification requirements as set out in these Terms.

3.3 Registration Requirements

To register, you must provide your full name, a valid email address, and create a secure password (or connect via a supported third-party account). You are solely responsible for maintaining the security of your account credentials and for all activity carried out under your account.

• All information provided must be accurate, current, and complete at all times.
• You may not share, transfer, or permit others to use your account.
• Notify Bkomas Auto immediately of any unauthorised access to your account.

3.4 Verification

Bkomas Auto may conduct identity checks, driver's licence verification, and vehicle eligibility assessments in accordance with applicable law. We may use authorised third-party services to assist in this process. While we take reasonable care in our verification procedures, we do not guarantee the accuracy of all information submitted by users.

4. Chauffeured Car Rental — Terms

4.1 Rental Duration

Chauffeured rentals operate on a 12-hour daily basis, concluding at 8:30 PM on the day of hire. This applies regardless of when the booking begins — afternoon bookings still end at 8:30 PM on the same day.

4.2 Overtime Charges

If your trip continues beyond 8:30 PM, the following overtime rates apply:

For extended or multi-day bookings, the standard late return policy in Section 7.3 applies.

4.3 Driver's Allowance

The driver's allowance is included in all chauffeured rental fees. No additional payment to the driver is required beyond the agreed rental amount shown on your booking confirmation. Direct payments to drivers outside the platform are prohibited.

4.4 Accommodation (Out-of-Accra Trips)

For multi-day chauffeured bookings outside of Accra, the driver will require accommodation. You may either arrange suitable accommodation directly or request that the cost be added to your booking invoice.

4.5 Fuel

Fuel is not included in the rental fee. Customers are responsible for fuelling the vehicle throughout the rental period.

4.6 Security Deposit

A refundable security deposit may be required at the time of booking. The deposit amount is set per vehicle listing by the Car Owner and will be clearly displayed before you confirm your booking. The deposit is fully refundable upon return of the vehicle in good condition and in compliance with all Terms.

4.7 Payment

Full payment is required before the rental begins. Accepted payment methods: Mobile Money, Bank Transfer, and Card (via Paystack).

4.8 Cancellation Policy

Cancellations are only possible while your booking status is Pending or Confirmed. Once a booking is in progress, cancellation is no longer available through the platform.

Refunds are processed via Paystack and typically received within 1-2 business days.

4.9 Vehicle Use

Vehicles must only be used within the destinations agreed upon at the time of booking. If you need to change your travel route, inform Bkomas Auto in advance so your booking can be updated accordingly.

4.10 Rental Extensions

To extend a chauffeured booking, contact Bkomas Auto at least 24 hours before your current booking ends. Payment for the extension must be made promptly to confirm the additional time.

5. Self-Drive Rental — Terms

5.1 Minimum Booking Duration

All self-drive rentals have a minimum booking period of three (3) consecutive days.

5.2 Rental Rates & Approved Destinations

Rental pricing is based on your intended destination(s) as confirmed at the time of booking. The vehicle must be used strictly within the agreed destination(s). Should the vehicle move beyond the confirmed location, an additional 25% daily penalty plus any applicable outside-Accra surcharge will be applied. All pricing is displayed transparently on the vehicle listing before you book.

5.3 Rental Period

• Standard vehicles — 24 hours per day.
• Luxury vehicles (e.g., Prado, Pajero) — 12 hours per day.

5.4 Fuel

Fuel is not included. Vehicles are delivered with a full tank and must be returned at the same fuel level. Failure to do so will result in a fuel shortfall charge deducted from the security deposit.

5.5 Security Deposit

A refundable security deposit is required and is set by the Car Owner per vehicle listing. The exact amount will be displayed on the booking summary before payment. Deposits are processed as part of your total booking amount and are refunded within 1–3 business days after vehicle inspection, provided all terms are met. Any deductions for damage, cleaning, or fuel shortfalls will be communicated to you before the refund is processed.

5.6 Delivery & Collection

All vehicles are delivered and collected by Bkomas Auto. A delivery fee applies and is set per vehicle listing — the exact amount is shown clearly during booking. Customer collections from our premises are not available. Deliveries and collections take place Monday to Saturday only.

5.7 Payment Terms

Full payment must be received before delivery. Accepted methods: Mobile Money, Bank Transfer, and Card (via Paystack).

5.8 Driver's Licence

Only the person(s) whose valid driver's licence has been submitted to Bkomas Auto may operate the rented vehicle. Allowing an unlicensed or unregistered person to drive constitutes a serious breach of this Agreement.

5.9 Vehicle Condition

Vehicles must be returned in the same clean, undamaged condition in which they were delivered, with the same fuel level. Additional charges will apply for vehicles returned dirty, damaged, or below the agreed fuel level.

5.10 Damage, Breakdowns & Fines

In the event of an accident, dent, mechanical fault, or traffic fine, you must contact Bkomas Auto customer support before taking any action on the vehicle. Arranging repairs, paying fines, or making any settlement without prior authorisation may result in additional charges or forfeiture of your deposit. Any damage that occurs during the rental period is the customer's full financial responsibility.

5.11 Rental Extensions

To extend your booking, contact Bkomas Auto at least 24 hours before your rental ends. Pay the extension invoice promptly to confirm the additional days.

5.12 Cancellation Policy

Cancellations are only possible while your booking status is Pending or Confirmed. Once a booking is in progress, it cannot be cancelled.

Refunds are processed via Paystack and typically received within 1-2 business days.

5.13 No Smoking Policy

Smoking is strictly prohibited in all Bkomas Auto vehicles. A fixed penalty of GH₵ 250 will be charged to the customer if evidence of smoking is found in the vehicle upon return.

5.14 Long-Hire Inspection (21 Days and Over)

For bookings of 21 days or more, the customer is required to bring the vehicle to Bkomas Auto for a physical inspection every 10 days throughout the rental period. Failure to comply with the inspection schedule may result in termination of the rental agreement.

5.15 Electric Vehicle (EV) Battery Policy

Rental fees do not include battery charging costs. The following rules apply to all EV rentals:

• The battery must never fall below 30% during the rental period.
• For city driving — charge to a maximum of 80% (frequent full charges degrade the battery).
• For long-distance trips — charging up to 100% is permitted.

6. Platform Users — Customers, Car Owners & Drivers

6.1 Customer Commitments

As a Customer, you agree to:

• Hold and provide proof of a current, valid driver's licence.
• Treat the vehicle and all accessories with care and return them in the same condition as received.
• Only allow persons listed as Approved Drivers to operate the vehicle.
• Use the vehicle for personal use only — not for commercial activities such as ride-hailing or goods delivery.
• Operate the vehicle in compliance with all applicable laws and traffic regulations.
• Not make any direct payment to a Car Owner or Driver outside the platform.

6.2 Customer Financial Responsibility

The primary Customer is financially responsible for all physical damage to or theft of a booked vehicle during the rental period, regardless of fault. This applies whether or not the Customer holds personal auto insurance. You agree to cooperate with Bkomas Auto in processing any applicable insurance claims.

6.3 Vehicle Theft

The following conduct may result in the vehicle being reported as stolen to law enforcement and may void any applicable protection plan:

• Failing to return the vehicle at the agreed time and location.
• Not returning the vehicle by the end of the reservation period without an approved extension.
• Returning the vehicle to an unauthorised location.
• Misrepresenting facts in connection with the booking or use of the vehicle.
• Leaving the vehicle unattended, unlocked, or running, resulting in theft or damage.
• Failing to cooperate with law enforcement or Bkomas Auto following an incident.

6.4 Car Owner Commitments

As a Car Owner listing your vehicle on the Bkomas Auto platform, you agree to:

• Provide a safe, roadworthy, legally registered, and insured vehicle with a clean title.
• Ensure the vehicle is clean, mechanically sound, and fully fuelled before each rental.
• Keep your vehicle listing accurate, complete, and up to date — including daily rate, delivery fee, and security deposit amount.
• Respond to rental requests within 24 hours.
• Carry out an inspection after each rental and report any damage within 24 hours of the trip end.
• Comply with all applicable laws, regulations, and safety requirements.
• Maintain a valid safety vest and warning triangle in the vehicle at all times.
• Not list any vehicle that is subject to a missing, stolen, or outstanding safety recall notice.

6.5 Car Owner Cancellations

If a Car Owner cancels a confirmed booking, the Customer receives a 100% refund. Car Owners who cancel within 24 hours of the booking start time will be flagged on the platform and may be subject to disciplinary action, including temporary or permanent account suspension.

6.6 Driver Commitments

As a Driver offering chauffeured services through the Bkomas Auto platform, you agree to:

• Complete the Driver onboarding process and maintain an accurate, up-to-date driver profile including your daily service fee.
• Hold a current, valid driver's licence at all times and present it upon request.
• Conduct yourself professionally and courteously with all Customers at all times.
• Only accept bookings you are able to fulfil — do not accept and abandon a booking.
• Operate strictly within the destinations and hours confirmed on the booking.
• Not request or accept any direct payment from a Customer outside the platform.
• Not operate a vehicle under the influence of alcohol, drugs, or any impairing substance.
• Report any incidents, accidents, or vehicle faults to Bkomas Auto before taking any independent action.
• Comply with all applicable traffic laws and regulations at all times.

6.7 Driver Earnings & Commission

Driver fees are calculated based on the daily service rate set in your driver profile, multiplied by the number of booking days. Bkomas Auto retains a 10% platform commission on all driver service fees processed through the platform. Net earnings are disbursed to your registered mobile money or bank account following booking completion, subject to the escrow and payout schedule in Section 7.5.

7. Payments, Pricing & Fees

7.1 Payment Methods

All rental fees are payable in full before the commencement of a booking. Platform payments are processed securely via Paystack (Mobile Money, Bank Transfer, or Card). Cash is not accepted for any transaction on the platform.

7.2 Pricing Breakdown

Your total booking amount is calculated transparently and may include:

7.3 Late Return Fees

Vehicles must be returned by end of day on the agreed return date. If a booking remains active beyond its confirmed end date, late return fees are applied automatically as follows:

• First 24 hours overdue: Charged hourly at a percentage of the vehicle's daily rental rate, prorated by the hour.
• Beyond 24 hours: Charged at the applicable daily surcharge rate per additional day, rounded up to the nearest full day.

The late fee rate is set as a percentage of the vehicle's daily rental rate and is configurable by Bkomas Auto administrators. The rate in effect at the time of your booking will be displayed on the platform. Late fees are non-refundable and are added directly to your booking total.

7.4 Platform Commission (Car Owners & Drivers)

Bkomas Auto charges a commission on all earnings processed through the platform. Current default rates are:

Commission rates are configurable by Bkomas Auto administrators and are subject to change with reasonable notice. All rates in effect at the time of a booking are captured and applied to that booking.

7.5 Escrow & Payouts

Customer payments are held in escrow until the booking is successfully completed. Upon confirmed completion, the net payout — being the booking amount less the applicable platform commission — is released to the Car Owner or Driver. Disbursements are processed via the registered mobile money or bank account on file.

8. Prohibited Activities

By using the Bkomas Auto platform, you agree not to:

• Provide false, misleading, or fraudulent information of any kind.
• Impersonate another person or misrepresent your identity or qualifications.
• Use the platform for any unlawful, harmful, or unauthorised purpose.
• Allow unapproved persons to operate a rented vehicle.
• Sub-let or transfer a rented vehicle to any third party.
• Use a rented vehicle for commercial passenger or goods transport (e.g., Uber, Bolt, delivery services).
• Operate a rented vehicle under the influence of alcohol, drugs, or any impairing substance.
• Tamper with, modify, or attempt to repair the vehicle without Bkomas Auto's authorisation.
• Make or solicit direct payments outside the platform in connection with any booking.
• Interfere with the operation of the platform or other users' listings.
• Distribute malware, spam, or other harmful content via the platform.
• Solicit users to join competing services without prior written consent from Bkomas Auto.
• Infringe on Bkomas Auto's intellectual property or brand identity in any way.

9. Liability & Indemnification

Customers, Car Owners, and Drivers agree to defend and indemnify Bkomas Auto and its affiliates against any claims, losses, costs, or liabilities arising from the use of the platform or any rented vehicle, including but not limited to property damage, personal injury, or breach of these Terms.

Bkomas Auto's liability is limited to the direct provision of platform services. We are not liable for vehicle defects, mechanical failures, accidents, theft, or losses resulting from user conduct. We do not guarantee the accuracy of all user-submitted information.

10. Insurance & Protection Plans

Bkomas Auto is not an insurance provider. Protection plans available through the platform are offered for the benefit of Members at their discretion. To be eligible for coverage, users must comply with these Terms. Details of available plans are outlined within the platform.

11. User Content

By submitting content (photos, reviews, vehicle descriptions) to the Bkomas Auto platform, you grant us a non-exclusive, irrevocable right to use, adapt, display, and distribute such content for platform-related purposes, including marketing and promotion. You retain ownership of your content, but warrant that it is accurate and does not infringe on third-party rights.

12. Account Suspension & Termination

Bkomas Auto reserves the right to suspend or permanently terminate your account and access to the platform if we determine that you have violated these Terms, abused the platform, or engaged in conduct harmful to other users or to Bkomas Auto.

You may discontinue use of the platform at any time. Termination does not release either party from obligations incurred prior to termination, including outstanding payments or liability for damages.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from this Agreement that cannot be resolved amicably through direct discussion shall be submitted to the exclusive jurisdiction of the courts of Ghana.

14. Force Majeure

Neither party will be held liable for delays or failure to perform obligations caused by events beyond their reasonable control, including natural disasters, civil unrest, government actions, or other force majeure events. The affected party must promptly notify the other and take all reasonable steps to mitigate the impact.

15. Confidentiality & Data

Users agree to handle any technical or proprietary information obtained through the platform with strict confidentiality, and not to disclose such information to any third party without Bkomas Auto's express written consent. This obligation survives the termination of this Agreement. For details on how we collect, store, and use your personal data, please refer to our Privacy Policy.

16. General Provisions

• Entire Agreement — These Terms constitute the full agreement between you and Bkomas Auto and supersede all prior communications.
• Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• No Waiver — Failure to enforce any provision of these Terms does not constitute a waiver of that or any other provision.
• Language — English is the official language of this Agreement. All notices and correspondence shall be in English.
• No Assignment — You may not transfer your rights or obligations under this Agreement without Bkomas Auto's prior written consent.
• Notices — All formal communications must be in writing and delivered via the platform, email, or registered mail to the address on file.
